11. Whisky Cask Sales

11.1 Full payment for all related invoices is required in advance of ownership transfer, delivery or bottling. This may include warehousing and insurance costs for a set period.

11.2 VAT is not charged at the time of purchase if the spirit remains under bond. Excise duty and VAT become payable when the cask is released from bond. If the cask is sold to another party while still under bond, no VAT or excise duty would be payable.

11.3 Once ownership of the cask or casks is transferred, the buyer is liable for any taxes arising from the sale or disposal of the cask.

11.4 Buyer should expect natural evaporation of the spirit (around 3% per annum in Scotland, but variable) while casks are in storage. Alcohol by volume (ABV) tends to decrease with age due to evaporation. The buyer accepts these

11.5 The initial purchase may include insurance for a specified period (e.g., five years). Following the transfer of the cask into the customer's ownership, the customer bears all future costs of storage and insurance.

11.6 Adherence to HMRC and bonded warehouse regulations is essential, particularly for legal storage requirements of duty-suspended spirits. Anti-money laundering checks may be conducted before executing any agreement.

11.7 Risk of damage or loss passes to the buyer upon delivery. Until then, the goods should be stored and protected as the seller’s property.

11.8 This agreement and any disputes or claims arising out of or in connection with its subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the United Kingdom. The parties irrevocably agree that the courts of the United Kingdom shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
